1. About This Warranty

1.1

Scraptech Pty Ltd ("we", "our" or "us"), trading as ST Engineering, Hardwood Forest Products Australia and HFP Attachments, provides warranty coverage on eligible Goods and Services supplied by us in accordance with these Warranty Terms & Conditions.

1.2

These Warranty Terms & Conditions apply in addition to any rights and remedies available under the Australian Consumer Law.

1.3

Warranty coverage varies depending on the product, component or Service supplied.

1.4

Where a different or product-specific warranty period is expressly stated on a quotation, invoice, product documentation or product listing, that stated warranty period will apply to the relevant product or component.

2. Warranty Coverage

2.1 HFP Attachments – 5-Year Warranty

Eligible new HFP-branded attachments supplied by Scraptech Pty Ltd are covered by the HFP 5-Year Warranty.

The main attachment is warranted against original defects in materials, manufacture and workmanship for five (5) years from the original date of supply.

For the purposes of this warranty, the main attachment means the primary fabricated body, frame, mounting structure and welded components of the attachment.

The HFP 5-Year Warranty does not automatically extend to hydraulic, mechanical, electrical, drive, wear or consumable components. These components are covered separately as set out below.

2.2 Hydraulic, Mechanical & Electrical Components

Unless a different warranty period is expressly stated for a particular product or component, hydraulic, mechanical and electrical components are warranted against original defects in materials, manufacture and workmanship for twelve (12) months from the original date of supply.

These components may include, where applicable, hydraulic cylinders, hydraulic motors, rotators, slew drives, gearboxes, valves, solenoids, electrical components and other proprietary or bought-in components.

Where a particular product or component carries a longer expressly stated warranty, the stated longer warranty period will apply.

2.3 Wear & Consumable Components

Wear and consumable components are not warranted against normal wear, deterioration or consumption through use.

These may include, where applicable, pins, bushes, bearings, seals, hoses, hydraulic fittings, teeth, cutting edges, blades, wear plates, ground-engaging components and other items designed or reasonably expected to wear, deteriorate or require periodic replacement during operation.

This exclusion relates to normal wear, deterioration and consumption. It does not automatically exclude a claim where a wear or consumable component is alleged to have failed because of an original defect in materials, manufacture or workmanship.

2.4 Assessment of Wear & Consumable Components

Failure of a wear or consumable component during an applicable warranty period does not automatically establish a manufacturing defect and does not automatically exclude the component from warranty.

Scraptech Pty Ltd will assess the nature and likely cause of the failure having regard to relevant factors including:

  • the age and condition of the component;
  • operating history and usage;
  • the application in which the product has been used;
  • maintenance and servicing;
  • operating conditions;
  • photographs or video;
  • physical inspection where reasonably required; and
  • any other information reasonably relevant to determining the cause of the failure.

Where the failure is determined to have resulted from an original defect in materials, manufacture or workmanship, the applicable warranty will apply.

Where the failure is determined to have resulted from normal wear or deterioration, misuse, damage, inadequate maintenance, incorrect operation or another excluded cause, it will not be covered by the voluntary warranty.

Where the cause cannot reasonably be determined from the information initially provided, Scraptech Pty Ltd may require further information, inspection or assessment before determining the warranty claim.

2.5 Australian-Manufactured Products

Unless otherwise stated in writing, products manufactured by Scraptech Pty Ltd under ST Engineering or Hardwood Forest Products Australia are warranted against original defects in materials, manufacture and workmanship for twelve (12) months from the original date of supply.

Where a different warranty period is expressly stated for a particular Australian-manufactured product, the expressly stated warranty period will apply.

2.6 Workshop, Engineering & Other Services

Workshop repairs, fabrication, installation, modification, engineering and other Services performed by Scraptech Pty Ltd are covered by our workmanship warranty for the period stated on the applicable quotation, invoice or Service documentation.

The workmanship warranty covers defects arising from the workmanship performed by Scraptech Pty Ltd during the stated warranty period.

It does not cover subsequent damage, normal wear and tear, misuse, overloading, failure of existing components, customer-supplied parts or materials, or failures unrelated to the work performed by Scraptech Pty Ltd.

Nothing in this clause limits any rights or remedies available under the Australian Consumer Law.

2.7 Third-Party Branded Products

Products supplied by Scraptech Pty Ltd under another manufacturer's or supplier's brand are covered by the applicable warranty expressly stated for that product.

The HFP 5-Year Warranty does not automatically apply to third-party branded products.

3. Commencement of Warranty

3.1

Product warranties commence from the original date of delivery or collection unless otherwise expressly stated.

3.2

Workmanship and Service warranties commence from completion of the applicable Services unless otherwise expressly stated.

3.3

The voluntary warranties contained in these terms apply to the original purchaser unless otherwise expressly agreed in writing or required by law.

4. What the HFP 5-Year Warranty Covers

4.1

Subject to these Warranty Terms & Conditions, the HFP 5-Year Warranty covers original defects attributable to:

  • materials used in the manufacture of the main attachment;
  • manufacture or fabrication of the main attachment;
  • welding and welded joints; and
  • workmanship in the manufacture or assembly of the main attachment.

4.2

A failure, crack, deformation, weld failure or other damage occurring within the warranty period does not, by itself, establish that a defect in materials, manufacture or workmanship exists.

4.3

The nature and cause of the failure will be assessed in accordance with these Warranty Terms & Conditions.

5. What Is Not Covered

5.1

Unless otherwise required by law, the voluntary warranties provided under these terms do not cover failure, damage or deterioration caused by or resulting from:

  • normal wear and tear;
  • expected deterioration through age or use;
  • normal consumption of wear or consumable components;
  • misuse, abuse or negligent operation;
  • impact, collision or accidental damage;
  • overloading or excessive operating forces;
  • operation outside the intended application, operating limits or rated capacity;
  • use on an unsuitable carrier machine;
  • incorrect installation, fitment or setup performed by others;
  • incorrect hydraulic flow, pressure, settings or connections;
  • hydraulic contamination;
  • incorrect electrical supply or configuration;
  • inadequate servicing, lubrication or maintenance;
  • continued operation after a fault, excessive wear or damage becomes apparent;
  • improper transport or storage;
  • corrosion, oxidation or environmental deterioration;
  • exposure to salt, chemicals, excessive moisture or other corrosive environments;
  • modifications, alterations, welding or repairs that cause or contribute to the failure;
  • damage caused by the carrier machine, another attachment or external equipment;
  • buyer-supplied parts or materials; or
  • any other failure that is not attributable to a defect covered by the applicable warranty.

6. Corrosion, Paint & Finish

6.1

The voluntary warranty does not cover surface rust, corrosion or oxidation resulting from normal use, environmental exposure, improper storage, inadequate care or damage to protective coatings.

6.2

The warranty does not cover normal fading, scratching, paint chips, coating deterioration or cosmetic damage arising from use.

6.3

Attachments and equipment are working products and protective finishes may become scratched, chipped or damaged during normal operation. Customers are responsible for reasonable care and maintenance of exposed or damaged surfaces to minimise corrosion and deterioration.

6.4

Corrosion or deterioration occurring around a weld does not, by itself, establish that the weld was defective.

6.5

Where an original defect in materials, manufacture or welding is established independently of environmental deterioration, the claim may still be covered by the applicable warranty.

7. Maintenance & Operation

7.1

Goods must be operated, maintained and serviced appropriately for their intended application.

7.2

Where applicable, this includes appropriate:

  • lubrication;
  • inspection;
  • adjustment;
  • hydraulic setup;
  • servicing; and
  • replacement of worn components.

7.3

Failure to carry out appropriate maintenance does not automatically cancel the entire warranty.

However, warranty coverage does not apply to a failure to the extent that inadequate maintenance, servicing or operation caused or contributed to that failure.

8. Modifications, Welding & Repairs

8.1

Customers should contact Scraptech Pty Ltd before modifying, welding, dismantling or repairing an area that may be subject to a warranty claim.

8.2

Modification or repair of a product does not automatically cancel the entire warranty.

8.3

Warranty coverage does not apply to a failure to the extent that an alteration, modification, welding, incorrect repair or third-party work caused or contributed to the failure.

8.4

Scraptech Pty Ltd is not responsible under this voluntary warranty for unauthorised third-party repair costs.

9. Making a Warranty Claim

9.1

Warranty claims must be lodged with Scraptech Pty Ltd as soon as reasonably practicable after the customer becomes aware of the issue.

9.2

Claims may be lodged using the phone or email details contained in these Warranty Terms & Conditions.

9.3

To assess a warranty claim, Scraptech Pty Ltd may reasonably request:

  • proof of purchase;
  • product model and serial number or other identification;
  • machine make and model where applicable;
  • attachment or equipment fitment information;
  • description of the application and operating conditions;
  • approximate operating hours or kilometres where applicable;
  • photographs and/or video showing the issue;
  • maintenance and Service information where relevant;
  • details of when and how the issue occurred; and
  • other information reasonably required to determine the nature and cause of the failure.

9.4

Where reasonably practicable, Goods should not be dismantled, repaired, welded or modified in the affected area before Scraptech Pty Ltd has had a reasonable opportunity to assess the claim.

10. Warranty Assessment

10.1

Scraptech Pty Ltd may reasonably assess the nature and cause of an alleged failure before determining whether the failure is covered by the applicable voluntary warranty.

10.2

Assessment may include:

  • photographs and video;
  • information supplied by the customer;
  • operating and application information;
  • maintenance and Service history;
  • physical inspection;
  • technical or engineering assessment; and
  • consultation with an original manufacturer or component supplier where appropriate.

10.3

Where reasonably possible, claims may initially be assessed remotely before the Goods or affected component are required to be returned.

10.4

Where physical inspection is reasonably required, the customer must make the Goods or affected component available for inspection in accordance with reasonable instructions provided by Scraptech Pty Ltd.

11. Warranty Remedies

11.1

Where a claim is accepted under the applicable voluntary warranty, Scraptech Pty Ltd will provide an appropriate remedy having regard to the nature of the covered defect.

11.2

Depending on the circumstances, the remedy may include:

  • repair of the affected area;
  • repair of the affected component;
  • supply of replacement parts;
  • replacement of the defective component;
  • repair of the Goods;
  • replacement of the Goods where appropriate;
  • re-performance of affected Services; or
  • another appropriate remedy.

11.3

Replacement of an entire product is not automatically required where the covered defect can reasonably be rectified by repairing the product or replacing the affected component.

11.4

Nothing in this section limits any remedy to which the customer is entitled under the Australian Consumer Law.

12. Return Freight – First 12 Months

12.1

For a warranty claim made within the first twelve (12) months, where Scraptech Pty Ltd determines that return of the Goods or component is reasonably required for warranty assessment, Scraptech Pty Ltd will arrange or cover reasonable return freight to the location nominated by us.

12.2

The customer must obtain approval from Scraptech Pty Ltd before arranging freight for which reimbursement is sought.

12.3

Where assessment determines that the issue is not covered by the voluntary warranty, the customer may be responsible for reasonable inspection costs and freight required to return the Goods to the customer, provided those costs are advised before being incurred.

12.4

Nothing in this section limits any entitlement to reimbursement of reasonable transport or other costs available under the Australian Consumer Law.

13. Return Freight – After the First 12 Months

13.1

For claims made after the first twelve (12) months, Scraptech Pty Ltd may initially assess the claim using photographs, video and other information before requiring physical return of the Goods or component.

13.2

Where physical inspection is reasonably required, the customer is responsible for arranging and paying the initial cost of returning the Goods or component to the location nominated by Scraptech Pty Ltd.

13.3

Where the claim is accepted as a covered defect under the applicable warranty, Scraptech Pty Ltd will reimburse reasonable return freight costs approved by us.

13.4

Where the claim is not covered by warranty, the customer remains responsible for the initial return freight, any reasonable inspection costs and freight required to return the Goods or component to the customer, provided any additional costs are advised before being incurred.

13.5

Nothing in this section limits any entitlement to reimbursement of reasonable transport or other costs available under the Australian Consumer Law.

14. Unauthorised Costs

14.1

Customers must obtain approval from Scraptech Pty Ltd before arranging:

  • third-party repairs;
  • warranty-related labour;
  • freight for which reimbursement is sought;
  • removal or installation work; or
  • other costs claimed under the voluntary warranty.

14.2

Costs incurred without prior approval will not automatically be reimbursed.

14.3

Nothing in this section limits any entitlement to recover reasonable costs or compensation that cannot lawfully be excluded.

15. Removal, Installation, Travel & Downtime

15.1

Unless expressly approved by Scraptech Pty Ltd or otherwise required by law, the voluntary warranty does not automatically cover:

  • removal of Goods from the carrier machine or equipment;
  • reinstallation;
  • onsite attendance;
  • travel;
  • machine hire;
  • substitute or replacement equipment;
  • loss of production;
  • loss of use;

16. Goodwill Assistance

16.1

Scraptech Pty Ltd may choose to provide assistance, repair, replacement or another remedy as a gesture of goodwill in circumstances where an issue is not covered by the applicable voluntary warranty.

16.2

Any goodwill assistance provided:

  • does not constitute acceptance that the issue was covered by warranty;
  • does not alter the applicable warranty terms or warranty period; and
  • does not create an obligation to provide the same or similar goodwill assistance in relation to another claim.

16.3

Nothing in this section limits any rights or remedies available under the Australian Consumer Law.

17. Repaired or Replaced Products & Components

17.1

Repair or replacement under the voluntary warranty does not restart the original warranty period.

17.2

Any repaired or replacement Goods or component remains covered for the balance of the original applicable warranty period, subject to these Warranty Terms & Conditions and any rights available under the Australian Consumer Law.

18. Original Purchaser

18.1

The voluntary warranties contained in these Warranty Terms & Conditions apply to the original purchaser and are not transferable following resale or transfer of ownership unless otherwise expressly agreed in writing or required by law.

19. Australian Consumer Law

• to cancel your service contract with us; and
• to a refund for the unused portion, or to compensation for its reduced value.
You are also entitled to choose a refund or replacement for major failures with goods.
If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion.
You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.

20. Relationship With Our Terms & Conditions

These Warranty Terms & Conditions should be read together with the Scraptech Pty Ltd Terms & Conditions and any applicable quotation, invoice or product-specific warranty information.

20.2

Where a quotation, invoice or product documentation expressly provides a different or longer warranty period for a particular product or component, the expressly stated warranty period will apply to that product or component.

20.3

Where there is an inconsistency concerning the voluntary warranty coverage expressly provided by these Warranty Terms & Conditions, these Warranty Terms & Conditions will apply to the extent of that inconsistency unless a different warranty has been expressly agreed in writing for the particular Goods or Services.
